These Terms of Service (“Terms”) govern your access to and use of the website and services operated under the name 852 Rooms at 852rooms.com (the “Services”). By creating an account, browsing, posting, or messaging on the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

852 Rooms provides an online platform to help people in Hong Kong find rooms, flatmates, and related listings, and to communicate with each other. We are a marketplace facilitator, not a landlord, estate agent, or party to any tenancy or rental agreement between users.

2. Eligibility & accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. Notify us promptly at support@852rooms.com if you suspect unauthorised access.

3. User conduct

You agree not to:

• Break the law or infringe others’ rights (including discrimination, harassment, or fraud);
• Post false, misleading, or deceptive listings or profiles;
• Spam users, scrape the Services in an abusive way, or attempt to bypass security;
• Upload malware or interfere with the operation of the Services;
• Use the Services to arrange illegal activity or unsafe meetups.

We may investigate reports, remove content, suspend or terminate accounts, and cooperate with authorities where appropriate.

4. Listings, enquiries & viewings

Listers are responsible for the accuracy of their ads and for complying with applicable laws (including fair housing and licensing rules where they apply). Seekers should verify details independently before paying deposits or signing agreements. Nothing on the Services is legal, financial, or property advice.

5. Messaging & safety

In-app messaging is provided for convenience. Stay alert to scams: avoid sending money to strangers off-platform, verify identities where reasonable, and use reporting tools if something seems wrong.

6. Paid features & billing

Some features may be paid. Prices, taxes, and renewal terms are shown at checkout where applicable. Payments may be processed by third-party providers (for example Stripe); their terms and privacy policy also apply to payment data they collect. Unless required otherwise by law, fees for digital services already delivered may be non-refundable.

7. Intellectual property

We own the Services’ branding, software, and content we create. You retain rights to content you upload; you grant us a non-exclusive licence to host, display, and distribute that content on the Services as needed to operate the platform.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis, to the maximum extent permitted by law. We do not guarantee uninterrupted access, error-free operation, or particular search results. We do not endorse users or listings and are not responsible for user-to-user dealings.

9. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services is limited to the greater of (a) the amount you paid us for the Services in the six (6) months before the claim or (b) HKD 500, except where liability cannot be limited by law.

10. Indemnity

You will defend and indemnify us and our affiliates, directors, and staff against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Services, or your breach of these Terms, except to the extent caused by our wilful misconduct.

11. Suspension & termination

We may suspend or terminate access to the Services at any time for breach of these Terms, risk to users, legal requirements, or operational reasons. You may stop using the Services at any time. Provisions that by their nature should survive (for example liability limits, indemnity, governing law) survive termination.

12. Governing law & disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Courts in Hong Kong have exclusive jurisdiction, subject to any mandatory rights you have under local consumer law.

13. Changes

We may update these Terms. We will post the updated version on this page and change the “Last updated” date. Continued use after changes become effective constitutes acceptance, where permitted by law.
